MommyKidz App User Agreement

Effective Date: 12th December 2023

This User Agreement (“Agreement”) governs your use of the MommyKidz mobile application (“App”) and any related services provided by MommyKidz. By accessing or using the App, you agree to comply with this Agreement. If you do not agree to these terms, please do not use the App.

1. Acceptance of Terms

By using the MommyKidz App, you agree to the terms outlined in this Agreement, the Privacy Policy, and any other policies referenced within the App. These terms apply to all users, including guests, registered users, and healthcare professionals.

2. Eligibility

You must be at least 18 years old to use the MommyKidz App. If you are under 18, your use of the App must be supervised by a parent or legal guardian who agrees to this Agreement.

3. User Accounts

Registration: To access certain features, you will be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account.

Accurate Information: You must provide accurate, current, and complete information during registration. Failure to do so may result in account suspension or termination.

Account Security: You agree to notify MommyKidz immediately of any unauthorized use of your account.

4. Privacy

5. Use of the App

Health Information:The information provided through the MommyKidz app, including health-related content in the knowledge library, pregnancy tracker, baby growth tracker, and all other self-care tools, is for informational purposes only. This information may vary based on individual health conditions and should not be considered medical advice. Always consult with a qualified healthcare provider before making any decisions related to your health. MommyKidz is not responsible for any decisions made based on the content provided through the app.

Permitted Use: You agree to use the App only for lawful purposes and in accordance with this Agreement. Therefore, you must follow the rules outlined in the agreement and not engage in any illegal activities or misuse the app in ways that violate the terms and conditions.

User Content: You are responsible for any content you upload, share, or post in the App. By sharing content, you grant MommyKidz a non-exclusive, worldwide, royalty-free license to use, distribute, and display the content.

6. Community Guidelines

All users must comply with the Community Guidelines to ensure a respectful and supportive environment. Violations of these guidelines may result in account suspension or termination.

7. Intellectual Property
Ownership: MommyKidz owns all intellectual property rights in the App, including trademarks, logos, and content.

User-Generated Content: By submitting content (e.g., posts, comments, stories), you grant MommyKidz the right to use, modify (without changing its meaning), or share your content in connection with the App. This allows us to ensure that the content fits our platform’s standards, such as formatting or clarity, while preserving the original intent of your submission.

Restrictions: You may not copy, reproduce, or distribute any part of the App without prior written consent from MommyKidz.

8. Prohibited Activities
You agree not to:

• Recommend any medical advice or any misleading personal healthcare procedure. 
• Post or share inappropriate, offensive, or illegal content.
• Make judgmental comments on any specific health situations of other users.
• Harass, threaten, or abuse other users.
• Judgemental comments on a specific health situation of others. 
• Attempt to gain unauthorized access to the App or its systems.
• Share false or misleading health information.
• Use the App for commercial purposes or unsolicited promotions.

9. Subscription and Payment

Certain features of the App are available through subscription services. By purchasing a subscription, you agree to pay all applicable fees. You may cancel your subscription at any time, but cancellation will not affect any fees already paid.

10. Termination

MommyKidz reserves the right to suspend or terminate your account at any time, without notice, if you violate any terms of this Agreement or engage in inappropriate conduct. Upon termination, your right to use the App will cease immediately.

11. Disclaimers and Limitation of Liability

Medical Information Disclaimer:
MommyKidz provides information and healthcare in separate settings. The content in the App, including the knowledge library, tips, and self-care tools, is for basic informational purposes only and is not intended to replace professional medical consultations. The knowledge library provides basic knowledge and should not be used for healthcare decision-making. Users are advised to make healthcare decisions only based on medical advice received through video/audio consultations or answers provided by MommyKidz-appointed doctors in the Q/A section.

As-Is Service: MommyKidz provides the App on an “as-is” basis. We do not guarantee that the App will be error-free, secure, or uninterrupted.

Limitation of Liability: In no event will MommyKidz be liable for any damages arising out of your use of the App, including direct, indirect, or consequential damages.

12. Amendments to this Agreement

MommyKidz reserves the right to modify this Agreement at any time. Any changes will be posted within the App, and continued use of the App after changes have been posted constitutes acceptance of the modified terms.
